GENARO PENA SENTENCED TO FIVE YEARS IN ILLINOIS DEPARTMENT OF CORRECTIONS FOR THE OFFENSE OF UNLAWFUL POSSESSION OF A CONTROLLED SUBSTANCE
McHenry County State’s Attorney Randi L. Freese announces that on July 3, 2025, Genaro Pena, 42 years old, of Harvard, Illinois, was sentenced to five years in the Illinois Department of Corrections for the offense of Unlawful Possession of a Controlled Substance, a Class 4 felony.
Pena was sentenced by the Honorable Judge Justin Hansen after having been found guilty following a jury trial that ended on April 15, 2024.

On May 6, 2024, members of the McHenry County Sheriff’s Narcotics Task Force executed a search warrant at 5925 Island Road, Harvard, Illinois where Pena was residing at the time with his brother.
Upon execution of the warrant, law enforcement discovered 42 grams of packaged cocaine, packaging material used for the sale and distribution of controlled substances, and multiple digital scales.
Both Pena, who is a documented member of the Latin Kings street gang, and his brother were arrested on the scene.
Pena’s long criminal history, which included previous felony drug convictions and crimes of violence, made him eligible for extended term sentencing.
Upon release from the Illinois Department of Corrections, Pena will also be placed on Mandatory Supervised Release for a period of six months.
The case was successfully prosecuted at trial by Assistant State’s Attorneys Steve Gregorowicz and Matthew Brodersen.
