JOSHUA BAILEY IS SENTENCED TO SEVEN YEARS IN THE ILLINOIS DEPARTMENT OF CORRECTIONS FOR CRIMINAL SEXUAL ASSAULT

McHenry County State’s Attorney Randi Freese announces that on July 1, 2025, Joshua Bailey, 28, of Kenosha, Wisconsin, was sentenced to seven years in the Illinois Department of Corrections on one count of Criminal Sexual Assault, a Class 1 felony.

The sentence was handed down by the Honorable Judge Mark Gerhardt after Bailey entered a negotiated plea of guilty to the charge.

In November 2024, multiple videos of Bailey having sex with an unconscious victim were discovered.

With the assistance of the victim, detectives from the McHenry County Sheriff’s Police Department were able to determine the locations where the various assaults had occurred.

Bailey was charged in the states of Illinois and Wisconsin for the assaults.

The charge in Wisconsin is still pending.

Truth-in-Sentencing will require that Bailey serve a minimum of 85 percent of his sentence prior to being released from the custody of the Illinois Department of Corrections.

Upon release, Bailey will be subject to a Mandatory Supervised Release period ranging from three years to the rest of his natural life. He will also be required to register as a sex offender for the remainder of life.

State’s Attorney Randi Freese commends the victim for her courage to report the assault and the McHenry County Sheriff’s Police Department for their investigative efforts.

Freese would like to especially recognize Detectives Naatz and Stone for their work on this case.

This case was successfully prosecuted by Assistant State’s Attorney Elizabeth M. Vonau.
