DANIEL SWIDERSKI SENTENCED TO THREE YEARS IN THE ILLINOIS DEPARTMENT OF CORRECTIONS FOR AGGRAVATED DOMESTIC BATTERY CHARGE

McHenry County State’s Attorney Randi L. Freese announces that on January 13, 2026, Daniel Swiderski, 31, of Lake in the Hills, Illinois, was sentenced to three years in the Illinois Department of Corrections for a Class 2 felony Aggravated Domestic Battery charge.  

Swiderski was sentenced by the Honorable Judge Mark Gerhardt after entering a negotiated plea of guilty.

On May 27, 2025, just after midnight, the Lake in the Hills Police Department were dispatched to Swiderski’s residence regarding a 911 call for a report of a domestic disturbance.

Once on scene, officers attempted to make contact with the occupants for over an hour with no avail.

After hearing a clear cry for help coming from a female from inside the residence, officers made entry.

Officers observed the victim to be crying, bleeding from her face, and held by Swiderski in an upstairs bedroom.

Upon further investigation, officers discovered that Swiderski had strangled the victim multiple times prior to police entry.  

Under Illinois law, truth in sentencing applies to the charge of Aggravated Domestic Battery, requiring Swiderski to serve 85% of the sentence imposed. Upon release from custody, Swiderski will be placed on Mandatory Supervised Release for a period of four years.

While Swiderski had no prior criminal history and this charge was probation-eligible, the seriousness of Swiderski’s actions warranted a prison term.

State’s Attorney Freese would like to commend the work of the Lake in the Hills Police Department for their diligent investigation and dedication to staying on scene until making contact with the occupants of the home to ensure the victim was safe.   

This case was successfully prosecuted by Deputy Criminal Chief Margaret O’Brien.
