The U.S. Supreme Court ruled that tax sales, a process through which local governments obtain overdue property taxes, was unconstitutional because the delinquent taxpayers were cheated out of the difference between what was owed and the tax owed.
The guts of the decision is “the takings clause in the Fifth Amendment, which bars the government from taking private property ‘without just compensation.'” (From USA Today’s story.)
Illinois Democrats in the General Assembly have refused to address the issue.
Now comes information from USA Today with a solution some states have adopted:
“Since 2023, some states − Oregon, Massachusetts and Maine – now require seized homes to first be marketed by a real-estate broker at fair market value.”
