COURT GRANTS STATE’S ATTORNEY’S OFFICE’S PETITION TO DETAIN MAN ACCUSED OF AGGRAVATED BATTERY AND UNLAWFUL POSSESSION OF WEAPON

McHenry County State’s Attorney Randi Freese announced today that the Honorable Judge Nader granted the State’s petition to deny pretrial release for Jesus Figueroa, 24, of Harvard, Illinois.

Figueroa appeared in Initial Appearance Court on December 23, 2025, charged with one count of Aggravated Battery, a class 3 felony, as well as Unlawful Use of a Weapon, a class 4 felony.

Evidence was presented in court this afternoon that on September 13, 2025, Figueroa arrived at the Taco Bell in Harvard on his motorcycle.

Upon arrival, Figueroa approached the victim, a person otherwise unknown to Figueroa, wearing a black mask.

Figueroa shoved the barrel of a pistol into the stomach of the victim, telling the victim to leave the area.

The victim then left the Taco Bell and drove to a nearby Walmart.

Figueroa followed the victim to Walmart, where the victim called the police.

The police located Figueroa and the motorcycle in the Walmart parking lot, at which time Figueroa fled from the police.

The police pursued Figueroa, ultimately losing sight of him when he crashed his motorcycle and fled on foot into nearby woods.

Officers located a firearm in the saddlebag on Figueroa’s motorcycle.

During the hearing on the State’s Petition to Deny Pre-trial Release, Judge Nader found that there were no conditions or combinations of conditions that the court could impose to keep the community safe based on dangerousness.

State’s Attorney Freese commends the Harvard Police Department for their thorough investigation that led to these charges.

Figueroa’s next court appearance is scheduled for December 29, 2025, in courtroom 304.

Members of the public are reminded that this complaint contains only charges and is not proof of the defendant’s guilt. A defendant is presumed innocent and is entitled to a fair trial in which it is the government’s burden to prove his or her guilt beyond a reasonable doubt.
